Power Attorney

Completing a Power of Attorney can be a very sensible form of forward thinking. By thinking about what may happen in the future, you can ensure your best interests are looked after.

By creating a Power of Attorney, you give someone the power to make decisions on your behalf when you come to lack the mental capacity to do so. As such, you can ensure that whatever happens in your future, there is someone you trust that can look after your affairs.

You can specify what powers your attorney will have and whether your attorney has a general power to do anything that you are legally able to delegate or a limited power to deal with particular property or affairs.

Two different types of Lasting Power of Attorney

  • Health and welfare – This type of Power of Attorney allows you to select someone to make decisions about things such as your daily routine, your medical care and whether or not you should have life-sustaining treatment. This type of power of attorney can be used only when you have been declared unable to make your own decisions.
  • Property and finances – Unlike a Power of Attorney for health and welfare, this kind of power of attorney can look after your affairs at any time throughout your life. They can help make decisions about things such as paying bills and selling your home.
